What is your opinion about International Disabled Convention?

Article1. The government is required to make available and support the grounds which are considered practicable for providing the disabled people’s rights.

Note. In this law, the term disabled is applied to a person who, according to the diagnostic confirmation of the Medical Council of Welfare Organization, by either a physical, mental, or psychological injury, or all of them, has undergone a continuous disturbance in health or common viability by which his/her individual self-reliability in the social and financial domains is reduced


Article 2. In designing and constituting, it is mandatory to all of the governmental departments, offices, institutes, agencies, and the public and revolutionary units(those units related to Islamic Revolution) to guarantee the serviceability and profiting of the public constructions, buildings, passageways, and service facilities to the disabled people to be equal to the normal citizens.

Note1. All of the governmental departments, offices, institutes, agencies, and the public and revolutionary units are required to assure the serviceability and profiting of the public constructions, buildings, passageways, and service facilities to the disabled people through their annually passed budget.

Note2. All of the municipalities are required to refrain from issuing the license of the accomplishment of the construction for those buildings, public places, and passageways where the specialized standards which are considered to be necessary for the use of disabled people are not observed.

Note 3. Welfare Organization is allowed to keep under surveillance the activities that are being executed in the process of facilitating the public buildings and places by unites which are mentioned in the above article, and ask them to surrender the reports of their operations.

Note 4. The executive book of regulations of the above article will be prepared by the Welfare Organization jointly and certified by the Committee of Ministers in three months.


Article 3. It is mandatory to the Welfare Organization to take the following actions within the framework of the passed credits in the laws of the annual budget:

A. to provide the services of rehabilitation, patronage, education, and profession training with the cooperation of the disabled people’s families and participation of the private, non-governmental, collaborative, and philanthropic organizations, and subsidize the non-governmental centers and families.
B. To develop the educational, rehabilitative, and centers and sanitarium of the disabled people who are considered to have the necessary qualifications. (Disabled people who are indigent, unsupervised, or have behavioral disorders or unknown identities.)
C. To provide and consign the rehabilitation-enhancing devices which are requisite to the disabled people.
D. To develop the educational, manufactural, and protective workshops and propose the professional services of rehabilitation to the disabled people with the aim of empowering them.

Note. Those educational, manufactural, and protective workshops of the disabled people that are the subject of the above article are excluded from the November 3 1990 (3rd. 5. 1990) working legacy.


Article 4. The disabled people are authorized to be benefited by the half-price comfort in using the recreational, cultural, and sport facilities, or the governmental means of transport (airplanes, trains, and metros).

Note. Islamic of Culture and Guidance and Physical Education organization, and the municipalities are obligated to construct and equip their sport and recreational places, parks, and libraries in a way that they be serviceable to the disabled people.

Article 5. After being recognized by the Social Welfare Institute, those who are under the guardianship of the disabled people will be benefited by the Medical Services Insurance, and the disabled people will be under the cover of medical services insurance and the supplementary insurance of therapy.

Article 6. In the families that one or both of the parents or at least two of their children suffer from disablement, one of the children is exempted from military service.

Note. Those husbands who have their disabled wives under sustainment will be exempted from the military service as long as they undergo such sustainability.

Article 7. With the purpose of increasing the vocational chances for the disabled people, the government is required to take the following actions:

A. To attribute exclusively and at least three percent of the contractual, hiring, official, and laboring licenses of the public or governmental organizations encompassing the ministries, institutes, offices, and the public or revolutionary units that use the national budget of the country to the disabled people who have the necessary qualifications (as asserted in the article 3).
B. To provide the insurance right of the employer’s share and remunerate it to those employers who take the disabled people into service.
C. To pay the credit facilities (under management amounts) as much as it is passed in the laws of the annual budget to the corporative, constructive, manufacturing, and servicing units along with the productional-sponsoring workshops in reward for hiring disabled people.
D. To pay the credit facilities (under management amounts) to the offices and institutes where more than sixty percent of the stocks belong to the disabled people, with the aim of constructing the occupation-enhancing units of servicing and manufacture
E. To pay the credit facilities (under management amounts) of self-employment to the disabled people as much as it is passed in the laws of the annual budget.
F. To attribute exclusively and at least sixty percent of the telephone-operator positions of the organizations, governmental institutes, and public units to the sightless or quasi-unseeing, and those of the disabled people who are physically challenged or endure difficulties in motioning.
G. To attribute exclusively and at least sixty percent of the organizational positions in relation to office-management and typing of the institutes, offices, and the public units to the physically challenged people or those who endure difficulties in motioning.

Note 1. All of the governmental departments and offices, institutes, agencies, and the public and revolutionary units are allowed to take into service those disabled people who suffer from the hearing impairment, sightlessness, and spinal cord injuries and disabilities and have the necessary qualifications in a situational manner and without appointees’ examination within the limits of their annual hiring-licenses.

Note 2. Management and Planning Organization Is obliged to reduce three percent of the annual hiring-licenses of the ministries, organizations, governmental institutes, and the revolutionary and public unites and offices and allocate it to the Welfare Organization in order to execute the required actions to accomplish the particularized appointees’ examination for the disabled people who have the necessary qualifications and introduce those disabled appointees who are accepted to the related organ in accordance with the situation with the association of Management and Planning Organization.

Note 3. Welfare Organization is allowed to found a payroll department of job opportunities for the disabled people and the assistance-requiring members of the Welfare in accordance with the profile of its authorized credits and bring its article of association under the ratification of Committee of Ministers.

Note 4. Professional and Technical Training Organization is required to proffer the needed technical and vocational trainings complimentarily and conjointly to the disabled people in proportional to the labor market.

Article 8. The disabled people with different ages who are in need and have the necessary qualifications can be benefited from the free education through the recognition of Welfare Organization

Note. Within two months after declaration of this article, its executive book of regulations will be jointly prepared by the Islamic Azad University and the above-mentioned ministries and certified by the Committee of Ministers.

Article 9. the Ministry of Housing and Urban Development, Housing Bank, and the Housing Foundation of the Islamic Revolution are required to attribute exclusively at least ten percent of their residential unites which are constructed for rental purposes and with the low price to the disabled people who are in need of habitation and cede those unites to them through the recognition the Welfare Organization.

Note 1. Banking system of the State is obliged to provide the subsidy credit facilities which is needed for constructing and buying disabled people residential unit and is required to pay to the aforementioned persons, or the cooperative units, or the philanthropic organizations which construct residences for them.

Note 2. National Organization of Land and Housing is required to provide the lands needed for constructing the residential unites of the disabled people who are in short of habitation with the expert pricing and give those lands to the aforementioned persons, the cooperative units, or the philanthropic organizations which construct residences for them.

Note 3. The disabled people are exempted from bearing the expenditures of issuing the constructive license, land preparation, and paying taxes on property renovation.

Note 4. Welfare Organization is required to take action on the subject of constructing residential unites for the disabled and assistance-requiring people within the framework of the passed credits in the laws of its annual budget and the legal and real entities’ supports via subsidy and give the ownership and the right of exploitation of these units to the disabled and assistance-requiring people according to the book of regulations which Welfare Organization prepares with the association of Housing and Urban Development Organization and surrenders to the Committee of Ministers to be certified.

Article 10. The amount of the subsidy which Welfare Organization pays to the non-governmental centers (quotidian and circadian) on account of rehabilitative, educational, and profession training services will be jointly and annually prepared in accordance with the exhausted cost of the services and yearly inflation by Welfare Organization, Management and Planning Organization, and of Commerce and given to the Committee of Ministers to be certified before the April of each year.

Article 11. Statistical Center of Iran is obliged to conduct the public census of the country population in a way that the population of the disabled people be distinctively counted in regard to their types of disability.

Article 12. Islamic Republic of Iran Broadcasting Is required to attributing two hours of its weekly programs in the proper time to the schedules of Welfare Organization and the process of familiarizing the society with the potencies and abilities of the disabled people.

Article 13. Welfare Organization is required to take action on bringing the disabled people under the guardianship by the appropriate procedures, the law courts are required to issue their verdicts on the topic of dismissing or appointing the guardian of the disabled people strictly under the advisement of the above-mentioned organization.

Note 1. In order to protect the rights of the disabled people in the judicial courts, Welfare Organization is required to appoint the lawyers and introduce them to the related court.

Note 2. The executive book of regulations of this article will be jointly prepared in the duration of three months by the Welfare Organization and The Ministry of Justice and certified by the Committee of Ministers.

Article 14. The taxpayers can take action on constructing the rehabilitative, medical, profession training centers and habitation which is considered needed by the disabled people under the management and advisement of the Welfare Organization. The certification of the costs disbursed by the taxpayers in the above situations which is confirmed by Welfare Organization will be granted as the regular payment of their taxes.

Note. the executive book of regulations of this article will be jointly prepared by Welfare Organization and The Ministry of Economy and Finance Affairs within three month after its legal issuing and certified by the Committee of Ministers.

Article 15. The supervisors of the provincial centers of Welfare Organization are allowed to attend the seminars of the council of planning and developing of the provinces and its working groups as members.

Note. The president of Welfare Organization is allowed to attend the seminars of the Supreme Council of Employment, with the aim of giving support to the procedure of employing the disabled people.

Article 16. The credit which is considered necessary for executing this law will be provided via the following sources:
1. The credits which organizations and units put aside according to their legal affairs.
2. The credits pertaining to that of the expenses and capital possessions from which Welfare Organization has given the necessary services to the disabled people so far.
3. The amounts collected from the project of putting the subsidies of the country on the right track.
4. The use of credit allocations reducing expenses in bodies , government companies and public institutions amounts of which shall be specified by council of ministries.


Note 1. the executive book of regulations of this article will be provided by Welfare Organization and Organization of Management and Planning, and certified by the Committee of Ministers.

Note 2. Those articles, or any part of them, which are in need of renewed credits will not be executed unless their required credit is not provided via the sources mentioned in this article.
